A substantial percentage of the UK population do not have a Will, even those that have made a Will do not regularly review them and as a result they become outdated as their circumstances change.
If you were to die without having a valid Will in place the laws of Intestacy would come into force and your estate would be distributed in accordance with the law. This could lead to lengthy delays in settling your Estate, during which time your Estate would be frozen and people who were not intended to benefit may be entitled to a share of your Estate to the detriment of your loved ones.
Making a Will protects your Estate and ensures that it is distributed as you intended. It can also provide some protection for young children, by appointing a specified Guardian to ensure that there is no dispute after your death as to who should look after them. In addition, it is an ideal time to consider the creation of Trusts and Lasting Powers of Attorney as well as making arrangements to ensure that any potential liability to Inheritance Tax is limited and adequate provision is in place for those with larger estates.
Most people who do not have a Will know they should do something, but have not yet done so, or they do not understand the implications that come with Intestacy. Making a Will protects your Estate for the benefit of your loved ones and ensures your Estate is distributed in the way you had intended.

Estate Planning may to many people mean making a Will, however it is much more than that. It is about making provision for your loved ones and yourself, whilst you are alive and well. Protecting your home and assets in the event of long term care expenses is important and it is also an ideal time to make provision for any potential Tax liability, so that you and your loved ones benefit from all your hard work. Should the unthinkable happen you and your loved ones are prepared.
